Report alleges NVIDIA chips continue reaching China's military despite US export controls, raising questions about enforcement effectiveness and black-market leakage.
New evidence is intensifying scrutiny of Nvidia's role in China's military artificial intelligence ambitions, raising questions about whether the company's lobbying efforts, export practices and compliance measures have undermined U.S. efforts to keep America's most advanced AI technology out of Beijing's hands.
For years, Nvidia CEO Jensen Huang has insisted that concerns about China using the company's advanced AI chips for military purposes are overstated. He has repeatedly argued that aggressive export restrictions would ultimately hurt the United States by encouraging China to build its own semiconductor industry while locking American companies out of one of the world's largest technology markets.
Recent developments suggest that China has not only continued pursuing Nvidia's chips despite tightening U.S. export controls—it has frequently succeeded. A New York Times investigation, drawing on research from software intelligence platform Wirescreen and thousands of Chinese government procurement records, found that organizations affiliated with nearly every major branch of China's military have sought Nvidia's advanced AI processors over the past six years. According to Wirescreen's analysis of roughly 3,800 procurement records, People's Liberation Army-affiliated organizations have pursued Nvidia chips in more than 500 procurement efforts since 2019.
The requests came from military organizations engaged in activities ranging from nuclear weapons simulations and military war games to offensive cyber operations and advanced high-performance computing. As Washington tightened export restrictions, Chinese entities simply adapted. Rather than abandoning efforts to obtain Nvidia chips, procurement officials lowered technical specifications, relied on intermediary companies, leased computing power from commercial data centers or used other methods to obscure the ultimate end user.
Those findings reinforce what national security experts have warned for years: export controls have limited China's access to the newest chips, but have not stopped determined buyers from obtaining Nvidia technology.
Criminal charges have added another layer of concern. In March, the Justice Department indicted three men associated with Super Micro Computer Inc. on charges of conspiring to sell billions of dollars' worth of Nvidia AI chips to unauthorized customers in China. Prosecutors allege the defendants used false export documents, shell companies, dummy servers and complex shipping routes to circumvent U.S. export controls.
Gregory Allen, chief executive officer of Decision Tree Research, a strategic technology and public policy research firm, said the case raises difficult questions about Nvidia's export security efforts. "The DOJ indictment shows explicitly that Nvidia distributors are involved in the smuggling of Nvidia chips to China," Allen said. "Nvidia is supposed to have an export security system. So the question is, how could a smuggling operation be happening at one of Nvidia's major distributors, right under their nose, and Nvidia doesn't uncover it?"
For years, Huang has argued that restricting exports too aggressively would weaken American competitiveness, reduce U.S. influence over global AI development and accelerate China's efforts to build domestic alternatives. Nvidia also mounted an extensive lobbying campaign, hiring influential firms and supporting organizations that argued allowing continued sales to China served America's long-term economic interests. While some policymakers accepted at least part of that argument, many national security experts did not.
"China's unprecedented military modernization effort is built on Beijing's foundational belief that AI-centric warfighting doctrines represent the future of contemporary conflict," said Jack Burnham, a senior research analyst at the Foundation for Defense of Democracies. "Any advanced AI chip, particularly those produced by Nvidia, furthers Beijing's ambitions to design its preferred force of the future and threaten the United States and its allies and partners."
The debate intensified again after the Trump administration modified aspects of existing export restrictions, allowing Nvidia to resume certain sales to China under revised conditions that included financial arrangements benefiting the U.S. government. Supporters argued the policy struck the right balance between protecting national security and preserving American technological leadership. Critics argued that greater access meant more U.S. technology aiding China's military aims.
Members of Congress from both parties have cited the findings while calling for tighter oversight of advanced semiconductor exports. Among the proposals is the AI OVERWATCH Act, which would give Congress a greater role in reviewing executive branch decisions involving exports of advanced AI hardware.
The emerging evidence from Chinese procurement records and federal criminal prosecutions suggests that, despite years of increasingly stringent export controls, China's military and defense establishment has continued finding ways to acquire Nvidia technology. Whether through intermediary companies, commercial data centers or sophisticated smuggling networks, Beijing's demand has persisted—and, in important cases, has been met. That reality is reshaping the debate in Washington. The central question is no longer whether China's military wants America's most advanced AI chips, but whether U.S. export policy and Nvidia's own efforts to expand access to the Chinese market have done enough to prevent those chips from strengthening the military capabilities of America's foremost strategic rival.
