Memory company Netlist files new ITC patent action against Micron over HBM (High Bandwidth Memory) technology used in AI accelerators.

Netlist has filed a complaint with the U.S. International Trade Commission alleging that Micron Technology infringes two High Bandwidth Memory patents used in advanced AI computing. The complaint names Micron as the respondent and also identifies Nvidia, Broadcom, and Google as downstream customers. Netlist is seeking exclusion and cease and desist orders against all respondents.

The patents at issue are U.S. Patent Nos. 12,308,087 and 12,646,537. According to Netlist, these patents cover technologies incorporated into at least Micron's HBM3E, HBM4, and HBM4E products.

This filing is separate from Netlist's August 11, 2026 complaint against Micron, which alleged infringement of four additional patents related to DDR5 RDIMMs and MRDIMMs. That earlier proceeding was instituted by the ITC on September 23 as Investigation 337-TA-1523 and also named Super Micro Computer, Hewlett Packard Enterprise, and Lenovo as respondents.

While the announcement represents the initiation of a new enforcement action, Netlist did not state that the ITC has instituted an investigation into the HBM allegations. The complaint marks Netlist's expansion of its dispute with Micron into memory technologies central to AI infrastructure, though the company's allegations of infringement remain unestablished pending any ITC investigation and finding.
