Oracle's major AI data center project faces a land dispute that threatens its completion and timeline.

Oracle's massive data center project in southern New Mexico, a critical component of the Stargate AI infrastructure initiative, is encountering significant real-world obstacles that no computing power can overcome. Permitting delays, environmental opposition, and water concerns have accumulated to the point where Oracle issued a force majeure notice in late September, essentially notifying its partners that external factors may prevent it from meeting key deadlines.

The project's construction debt is already trading at 89 to 91 cents on the dollar, signaling that lenders are pricing in meaningful downside risk.

Project Jupiter encompasses 1,400 acres of hyperscale data center campus in Dona Ana County, New Mexico, designed to deliver up to 2.45 gigawatts of power capacity. Stack Infrastructure, a portfolio company of Blue Owl Capital, is developing the site, with Oracle serving as anchor tenant. The servers would primarily support OpenAI workloads, making this a crucial element of the broader Stargate initiative. Blue Owl has committed approximately $3 billion in equity, while a bank consortium including Goldman Sachs has arranged up to $20 billion in construction debt.

Oracle's force majeure notice, dated September 24, 2026, points to power-related delays as the primary impediment. The notice allows Oracle to suspend certain financial obligations tied to project milestones disrupted by external regulatory holdups, particularly the permitting of a natural gas pipeline intended to fuel on-site power generation. That pipeline's timeline has now slipped to February 2027 at the earliest, pushing the project's 2028 operational target into jeopardy.

Air quality approvals have become another battleground, with local environmental groups raising objections about facility emissions. Water usage presents an additional challenge in a region where arid conditions make large-scale industrial consumers subjects of intense public scrutiny. In response, Oracle has pivoted its power strategy, stating it will deploy Bloom Energy fuel cells instead of the originally planned natural gas turbines—a shift that would substantially reduce the facility's air quality impact.

This is not Oracle's only Stargate complication. In Saline Township, Michigan, another Oracle-affiliated Stargate location has faced lawsuits over zoning disputes and environmental concerns that have delayed development.

Despite the force majeure notice, Oracle maintains that the project remains on schedule—a statement requiring creative interpretation, given that force majeure notices exist precisely to signal schedule risk. The company's willingness to adapt its power strategy demonstrates genuine commitment to completing the project, though commitment and completion remain distinct outcomes.
