Taiwan is considering criminalizing the smuggling of AI chip servers to China for the first time, according to a Bloomberg report published on June 9, 2026, at 8:10 AM EDT. Under current Taiwanese law, shipping AI chips to China without authorization does not constitute a criminal offense. Shares of Nvidia (NVDA) and Taiwan Semiconductor Manufacturing Co. (TSM) drew attention in premarket trading on Tuesday following the report. At the time of writing, both stocks were trading flat. Year-to-date, TSM has gained over 33%, while NVDA has climbed more than 10%.

Enforcement efforts have already intensified. Last month, Taiwanese authorities arrested suspected chip smugglers on document falsification charges. Official statements omitted key operational details, but investigators revealed that Japan was allegedly used as a transit point. Authorities suspect the defendants had already successfully routed at least one shipment of servers through that corridor before the hardware reached Hong Kong.
