The United States government is investigating Apex Logistics for allegedly facilitating unauthorized shipments of Nvidia AI accelerators to China.
U.S. authorities are investigating Singapore-based Apex Logistics over suspected shipments of restricted Nvidia artificial intelligence hardware to China, placing freight forwarders and other transportation providers under heightened scrutiny regarding their role in semiconductor supply chains.
According to individuals familiar with the matter, the probe is examining whether Apex transported AI systems manufactured by Super Micro Computer that contain advanced Nvidia chips in violation of U.S. export restrictions. The inquiry is reportedly led by the U.S. Commerce Department’s Bureau of Industry and Security.
Should enforcement action follow, this case could mark the first significant U.S. action against a transportation company for allegedly facilitating the illicit transfer of restricted semiconductor equipment to China.
Apex, a subsidiary of Swiss logistics group Kuehne+Nagel, stated it is aware of U.S. government interest in a limited number of shipments processed in 2024 that may have involved equipment ultimately destined for restricted locations. The company emphasized its full cooperation and ongoing commitment to regulatory compliance. Kuehne+Nagel confirmed that its subsidiary is cooperating with investigators, noting that the parent company has not yet been contacted by authorities.
This investigation potentially expands the compliance burden associated with advanced semiconductor exports beyond manufacturers, distributors, and technology traders to include logistics providers.
U.S. restrictions on advanced AI chips destined for China were initially implemented in 2022 and have been repeatedly tightened and revised since. These controls aim to prevent advanced computing equipment from bolstering Chinese military and intelligence capabilities.
For freight forwarders, the challenge is increasingly operational. A consignment labeled as computer servers may contain technology valued in the millions, subject to stringent destination and end-user controls. The U.S. investigation coincides with a separate probe by Taiwanese authorities into the alleged diversion of advanced Nvidia B300 systems to China via multiple Asian trade routes. Taiwanese prosecutors indicted nine individuals this week in connection with the alleged illegal sale and export of high-end AI servers. Among those charged is a manager at Nvidia’s Taiwan operations, alongside individuals with ties to Super Micro.
Prosecutors allege that 130 B300 servers were acquired using falsified documentation and arrangements designed to suggest the equipment would remain at a Taiwanese data center. Of these units, 74 ultimately reached Chinese customers, while 56 were intercepted prior to export. The routing underscores the complexities faced by customs authorities and freight operators. Prosecutors report that 50 of the 74 servers were shipped through Indonesia, 16 traveled directly to China, and 8 were routed via Japan and Hong Kong before arriving in mainland China.
Taiwanese prosecutors allege that the suspects employed false end-user information and other tactics to bypass export controls, seeking prison terms of up to five years for several defendants. Nvidia has not been formally accused of corporate wrongdoing, and Super Micro has stated it has cooperated with Taiwanese investigators.
Together, these cases underscore an escalating risk for international freight networks as governments work to seal indirect channels used to divert controlled technology. Advanced servers can transit established air cargo and multimodal logistics hubs without raising physical suspicion. Unlike weapons or hazardous materials, the compliance risk resides primarily in the internal technology, its technical specifications, end user, and final destination.
For global forwarders, this reality elevates the importance of rigorous customer screening, end-user verification, accurate commodity descriptions, and the detection of anomalous transshipment patterns. Consequently, the Apex case extends beyond a single logistics provider. Should U.S. authorities ultimately pursue enforcement action against a transportation firm, carriers and forwarders handling semiconductor equipment will likely need to redefine the boundary between routine transportation services and export control compliance responsibilities.
