The US's ambitious $500 billion artificial intelligence (AI) infrastructure project is facing a major setback at Project Jupiter, a data center complex in New Mexico. Oracle has issued a force majeure notice to the project developers, citing potential delays due to power supply issues and regulatory approval procedures. This move could help the company limit related payment obligations if contract conditions are met, given the uncertainty surrounding the operational start date.
Project Jupiter is being developed by a unit affiliated with the investment fund Blue Owl Capital, with Oracle as the key tenant, providing computing infrastructure for OpenAI. The project is a crucial link in the US's Stargate AI infrastructure plan, which was announced at the White House in January 2025 and involves OpenAI, SoftBank, Oracle, and MGX. The project aims to invest up to $500 billion over four years, with $100 billion allocated to the initial phase to build infrastructure for advanced AI models.
The biggest challenge for Project Jupiter lies in its power demand. To achieve operation by 2028, the complex requires an on-site power supply with a maximum capacity of approximately 2.45 GW. The initial plan, which used gas turbines and diesel generators, faced opposition from local communities and environmental organizations over concerns about emissions and water consumption. The Oracle, BorderPlex Digital Assets, and Bloom Energy consortium subsequently proposed using solid oxide fuel cells. However, this solution still requires gas sources, pipelines, and related environmental permits.
Legal hurdles have delayed the licensing process, even as factory construction continues. According to media reports, the situation is also putting pressure on the project's finances. The syndicated loan of approximately $18 billion related to Project Jupiter is reportedly trading at a discount in the secondary debt market, reflecting investors' caution regarding the risk of operational delays and contract disruptions.
Stargate's difficulties also reflect growing energy pressure in the US as businesses accelerate the construction of AI data centers. In Texas, the number of applications for power supply for data center projects is estimated to have reached hundreds of GW, putting pressure on grid planning and approval processes. This reality shows that the AI race doesn't just depend on processing chips or investment capital. Stable power supply, transmission systems, environmental permits, and community consensus are becoming key conditions determining the speed of AI infrastructure expansion.
