Oracle has invoked 'force majeure' on its New Mexico Stargate data center project, citing unforeseen circumstances that have halted or delayed construction on the joint OpenAI-Oracle facility.

Oracle has sent a force majeure notice to the developer of Project Jupiter, a Stargate data center campus in New Mexico, according to Bloomberg. The notice allows Oracle to delay payments should the facility miss its targeted 2028 completion date, though Oracle is not seeking to exit as the campus's main tenant. "Project Jupiter remains on our planned schedule," Oracle stated. "We are fully committed to New Mexico and confident in our path forward."

Blue Owl Capital, which received the notice, said the action "does not change the financial commitments to this multi-year project."

The notice follows a series of setbacks tied primarily to the site's energy infrastructure. The 2.45-gigawatt campus is designed to run on gas-powered fuel cells from Bloom Energy, making a reliable gas supply critical to its timeline. An Energy Transfer pipeline intended to deliver gas to the site has been delayed nearly six months, to February 1, 2027, after regulators repeatedly denied permits for the line. The route was changed following those rejections. A separate air-quality permit for the fuel cell system powering the campus remains pending, with the state's environment department facing a November 23 deadline to decide.

Project Jupiter is a flagship site for Stargate, the AI infrastructure initiative announced by Oracle, OpenAI, and SoftBank alongside President Donald Trump early in his second term. The campus has drawn opposition from residents and environmental groups, becoming a political flashpoint ahead of midterm elections. Oracle has launched a public outreach campaign in New Mexico aimed at addressing the project's critics.
